Terms & Conditions

Harry Benmore Mattress Maker is the trading name of 457MATTRESS Limited. The registered office is 45a-47, Bellegrove Road, Welling, Kent DA16 3PB. Registered in England.

1. Product.

All descriptions of our mattresses are correct at the time of publication.

All of our mattresses are bespoke and made to order.

The composition and construction of any of our mattresses may be adjusted depending on the customer’s requirements and preferences (size, tension, weight).

We have a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.

2. Measurements.

All measurements are rounded up to the nearest whole inch. Every care is taken to ensure all measurements are correct at the time of publication. Mattress sizes can vary slightly from dimensions given when new but will spread to full size with use. Mattress sizes can also vary slightly from dimensions depending on the mattress construction. Our mattresses are made to order and so there is a 1.5” tolerance on all dimensions.

3. Pricing.

Our pricing includes VAT and we reserve the right to adjust VAT if it changes. Prices are correct at the time of publication. In the unlikely event that the price of a mattress has been incorrectly advertised, we will contact you to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel the order.

4. Warranty.

Our products come with 10-year coverage using a traditional pro rata model (5-year guarantee + 5-year warranty). No false promises.

Any faulty mattress will be exchanged for a new one at no cost to the customer within the initial five-year guarantee.

The additional 5-year warranty covers repairs or replacement on a pro-rata basis.

If replacement is required, the customer will be subject to a usage charge. See below:

1-5 years: Mattress replaced at no cost to customer

5-6 years: Mattress replaced at 20% charge

6-7 years: Mattress replaced at 40% charge

7-8 years: Mattress replaced at 60% charge

8-9 years: Mattress replaced at 80% charge

9-10 years: Mattress replaced at 96% charge

The warranty covers any manufacturing or material defects that cause the excess dipping of the materials or springs.

*Please note that mattresses bought from the 'CLEARANCE' page of the website come with a 2 year guarantee only.

This warranty does not cover the following: comfort preference; fair wear and tear; neglect; abuse; fabric fading from exposure to sunlight; misuse of your goods; damage from external factors (i.e. bed bugs, moths, mould, bodily fluids, etc); damage caused by pets or if the product has been soiled in any way. We therefore suggest you purchase a mattress protector to avoid unnecessary disputes in this area.

Other possible issues that are deemed ‘cosmetic’ that do not affect the performance of the mattress and are not considered a fault:

-If the button detaches itself from the tuft or if a tuft pulls through into the mattress itself;

-Material settlement and indentation in the area where you sleep. Our foam and natural fillings are deep and generously layered. Compression, settlement and indentation is quite normal and to be expected. (Flip the mattress over and rotate it head-to-toe regularly to level the materials out again. Hybrid models only require rotating).

Warranties on our mattresses are void if they are placed on a divan bed base where the surface is collapsed/damaged/dipping as this will cause the mattress to follow suit.

Warranties on our mattresses are void if they are placed on a slatted bed base where slats are missing or if there is more than 4" (100mm) between each slat as it will cause uneven support for the mattress spring unit. Slats on a bed frame to be no less than 6cm minimum width.

Warranties on our mattress are void if they are clearly not maintained properly. You must flip and rotate it weekly for the first 3 months then every 4 weeks thereafter. Note: Hybrid models only require rotating.

Our warranties only apply to mattresses delivered to the UK mainland. If you have moved since your original delivery date, please let us know. If the mattress is removed from the mainland UK and you wish to claim under the terms of the warranty, you will be responsible for the shipping and shipping costs.

In some instances, we may choose to send a third-party inspector to view your mattress. In these cases, the decision of the inspector will be final.

A faulty mattress will be exchanged without delivery costs. Should you request the mattress to be exchanged for another of higher value, the difference in cost will be your responsibility. The replacement mattress warranty only carries forward the remaining length of the warranty on the original mattress.

This warranty is not transferable and will only apply to the original purchaser. These terms and conditions do not affect your statutory rights.

5. Sleep trials.

The ‘100 Day Sleep Trial’ applies to all mattresses and may be invoked by the original purchaser up to 100 days from date of delivery (however, we do ask that you give yourself at least 15 days to adjust to the new mattress). You can then exchange the mattress for another tension or a different model that you think will suit you better. Should you wish to upgrade or choose a higher value mattress, the additional cost will be your responsibility.

The ’100 Day Sleep Trial’ does not apply to mattresses made to bespoke sizes, or mattresses that have become defective due to misuse, wilful damage, accidental damage, neglect, general wear and tear or if the mattress has been soiled in any way. We therefore suggest you purchase a mattress protector to avoid unnecessary disputes in this area.

The ‘100 Day Sleep Trial’ is limited to one exchange only and only available to customers within Mainland UK.

 

The ‘100 Day Sleep Trial’ does not apply to Northern Ireland customers.

6. Payment.

Payment is due in full at the point of sale.

Once payment has been received in full by us, ownership of the mattress passes to you, the customer. However, we remain responsible for the mattress until delivery.

By making a payment against a mattress you are deemed to have accepted our Terms & Conditions.

 

7. Mattress disposal/recycling.

Our delivery partner, BJS LTD, offer a responsible and environmentally friendly recycling service of your old mattress for a fee of £59 which can be selected at checkout. They will only recycle up to the equivalent of what they are delivering to you, at the same time. We will send a bag for the mattress to be wrapped in before the delivery/collection takes place to keep it dry for recycling purposes. 

8. Delivery.

It can take anywhere between 5 and 15 working days for delivery. While every effort is made to meet the date, delays can occur that are beyond control. Where this happens, the courier, BJS LTD will keep you informed.

The standard ‘HALLWAY’ delivery is a free-of-charge, two-man service to the front door and over the threshold of your home.

The upgraded ‘UPSTAIRS’ delivery service is £39 and includes delivery to your room of choice plus unwrapping and disposal of the protective packaging.  Once the mattress is through quality control and handed over to BJS Ltd, their team will be in touch with you directly to arrange a suitable date for delivery approximately 3-5 days in advance to ensure you are available.

It is your responsibility to ensure there are no restrictions which will affect your mattress being delivered to a room within your property. This includes, but is not limited to, door dimensions, staircases and lifts.

On receipt of your new mattress, it is important that you fully check that it is in good condition with the delivery team. You will be asked to sign to confirm this. If a fault or damage is discovered, you should notify the delivery team and contact us within a reasonable time to arrange for an exchange. Delivery to Northern Ireland, there is a £99 delivery surcharge for each delivery and once an item has been delivered, we unfortunately do not offer any upgrade, returns, sleep trial or exchange in Northern Ireland, unless the item is faulty.


9. Returns

Once you have had your mattress delivered and it doesn’t quite feel right, you may exchange it for another, more suitable mattress by activating the ’100 Day Sleep Trial’. (See section 5 above).


If you are not happy with your purchase for any other reason, please notify us within 30 days of receipt by emailing us at hello@harrybenmore.com and we will arrange for a collection and a full refund. All refunds must be made to the original method of payment. Proof of purchase is required.

 

The sleep trial and return policy do not apply to Northern Ireland unless the product is faulty.

We will not refund any recycling/disposal costs if the service has already been executed successfully.

We will not refund special size/bespoke mattresses unless they are faulty.
